PURPOSE OF THIS PRIVACY POLICY  

This privacy policy aims to give you information on how FIT.live collects and processes your personal data through your use of the FIT.live website and apps, including any data you may provide through the FIT.live website or apps when you sign up to FIT.live and create a profile, sign up to our newsletter, publish content or purchase any product or service. 

This website and apps are not intended for children and we do not knowingly collect data relating to children.

It is important that you read this privacy policy together with any other privacy policy or fair processing policy we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy policy supplements other notices and privacy policies and is not intended to override them.

2. THE DATA WE COLLECT ABOUT YOU

We may collect the following data about you and these have been grouped together as follows:

  1. Identity Data: includes first name, last name, username or similar identifier, date of birth and gender.
  2. Contact Data: includes billing address, email address and telephone numbers.
  3. Financial Data: includes bank account and payment card details.
  4. Transaction Data: includes details about bookings, payments to or from you and other details of products or services you have listed or made available on FIT Broadcasting LTD, or booked and purchased from us or our users.
  5. Technical Data: includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access the website and app.
  6. Profile Data: includes your username and password, content you uploaded or populated your profile with, your interests and preferences, your portfolio of videos or pictures, your listing of services, purchases or orders made by you, your feedback and review responses, in-app communications.
  7. Usage Data: includes information about how you use our website and app, products and services.
  8. Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website or app feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

IF YOU FAIL TO PROVIDE PERSONAL DATA  

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

3.  HOW IS YOUR PERSONAL DATA COLLECTED? 

We use different methods to collect data from and about you including through:

  1. Direct interactions. You may give us your Identity, Contact and Financial Data by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:

a. create an account or profile on FIT.live;
b. list or book a service on FIT.live;
c. subscribe to our service, publications, updates and any blog posts;
d. request marketing to be sent to you;
e. enter a competition, promotion or survey; or

2. Automated technologies or interactions. As you interact with our website, we will automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, server logs and other similar technologies. 

3. Third parties or publicly available sources. We will receive personal data about you from various third parties and public sources as set out below:

a. Technical Data from the following parties:

i. analytics providers such as Google based outside the EU;
ii. possibly advertising networks, though none are used at the moment; and
iii. possibly search information providers, though none are used at the moment.

b. Contact, Financial and Transaction Data from providers of technical, payment services such as Stripe based outside the EU.

c. Identity and Contact Data from platforms such as Facebook, Linkedin or Google, when used for logging into the platform.

MARKETING

PROMOTIONAL OFFERS FROM US

CHANGE OF PURPOSE  

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

 If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you

However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

6. DATA RETENTION

FIT Broadcasting Services  retains the Personal Information we receive as described in this Privacy Policy for as long as you use our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements and comply with applicable laws. When we are no longer required to retain the Personal Information as described above, we will destroy, erase, or de-identify it. Legal requirements, however, may require us to retain some or all of the Personal Information we hold for a period of time that is longer than that for which we might otherwise hold it.

7. DATA SECURITY

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. We maintain commercially reasonable administrative, technical and physical safeguards (which vary depending on the sensitivity of the Personal Information) designed to protect against unauthorized use, disclosure or access of Personal Information. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.

By using the Services or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Services. If we learn of a security breach, we may attempt to notify you electronically by posting a notice on the Site or sending an email to you. You may have a legal right to receive this notice in writing.

8. YOUR LEGAL RIGHTS  

You have certain rights relating to how we process your personal data, including the right to:

  1. access the personal data that we may hold about you. If you wish to exercise this right please contact us letting us know that you wish to exercise your right of access and what information in particular you would like to receive. Please note that we may not be able to provide all the information you ask for, for instance if the information includes personal information about another person. Where we are not able to provide you with information that you have asked for, we will endeavour to tell you why. We will try to respond to any request for a right of access as soon as possible, but we will always do so within 1 month of receipt of your request and evidence of relevant ID;
  2. rectify any inaccurate personal data that we may hold about you. If you realise that any of the information that we hold about you is incorrect, please let us know and we will correct it as soon as we can;
  3. have your personal data erased in certain circumstances, for example, where it is no longer necessary for us to process your personal data or where you object to your data being processed on certain grounds (for example, for marketing purposes). Please note that to ensure that we do not collect any further information you should also delete our app from your mobile devices and clear our cookies from any device where you have accessed our Services. Where we delete personal information about you, we may still retain some or all of that information for other purposes such as maintaining financial records, protecting or enforcing legal rights, maintaining marketing suppression lists or for technical reasons such as maintaining technical security or our database integrity.
